TINJAUAN HUKUM EKONOMI SYARIAH TERHADAP PRAKTIK PENUKARAN UANG (FENOMENA MENJELANG LEBARAN HARI RAYA IDUL FITRI)

Abstract

This study aims to determine the legal review of Islamic economics on the practice of exchanging money before Eid al-Fitr. This type of research is descriptive qualitative. This research is in the form of research by studying and exploring literature that covers the problems that are the object of research. The results of this study indicate that: 1) Based on the National Sharia Council Fatwa Number: 28/DSN-MUI/III/2002 concerning the Sale and Purchase of Currency (Al-Sharf), exchanging money is permitted, 2) The business of exchanging money is permissible as long as it is based on mutual consent as stated in the Qur'an, Surah An-Nisaa', verse 29. And indeed the basic principle of muamalah according to fiqhiyah rules is al-ibahah (permitted). But with the note that the object (ma'qud 'alaih) is because of the services of the person who provides the money exchange with the ijarah contract, 3) In money exchange transactions, the money exchange service provider should use a clear contract, namely an ijarah contract, so that they do not get caught in a money sale and purchase contract, because in muamalah fiqh, exchanging similar types of money if there is an excess is not permitted, 4) Other factors that are the reasons why money exchange transactions are permitted include: a) additional money exchange is a reward for the difficulty of getting small change, b) because it contains great benefits in it, namely benefits in transactions to fulfill one's life, c) the practice of exchanging money is reflected as goodness, namely there is an element of mutual assistance between service providers and service users, d) the practice of exchanging money is a small form of people's economy, where people utilize the resources they control, e) the practice of exchanging money makes it easier for people to get small change without having to go to the trouble of queuing at the bank, and 5) The government is expected to support the productive ethos of the community who use business opportunities every holiday by always providing positive direction and guidance, not immediately judging the business as haram without providing solutions to the community, thus killing the job market. With the presence and role of the government, it can also minimize the circulation of counterfeit money
