BATASAN PEMUKULAN ANAK DALAM PENDIDIKAN ISLAM: STUDI INTEGRATIF MAQĀṢID AL-SYARĪ‘AH DAN HUKUM PERLINDUNGAN ANAK

This study aims to analyze the limitations of child corporal punishment in Islamic education through an integrative approach between maqāṣid al-sharī‘ah and child protection law in Indonesia. This research employs a library research method by examining relevant classical and contemporary literature. The findings reveal that, within Islamic legal perspectives, corporal punishment is only permitted in a very limited manner as a last resort, under strict conditions such as avoiding physical and psychological harm and maintaining educational purposes. From the perspective of maqāṣid al-sharī‘ah, such practices must align with the protection of life, intellect, and human dignity, thereby rejecting any form of violence that leads to harm. Meanwhile, under Indonesian positive law, particularly Law No. 35 of 2014 on Child Protection, all forms of violence against children are strictly prohibited. The study highlights a potential harmonization between Islamic values and modern child protection laws, both emphasizing the importance of child welfare and protection. Therefore, a contextual reinterpretation of Islamic teachings and a paradigm shift toward non-violent, compassionate educational approaches are necessary in contemporary Islamic education.
